For the convenience of the purchasing organizations (PO), to simplify the verification of whether the supplier delivers the goods they have purchased, some modules provide product photos. When announcing a purchase, the buyer specifies only the technical specification parameters but cannot specify a particular supplier or the manufacturer of the supplied product. After the competition, the buyer will receive one of the specified products offered at the lowest price at the time of order. In the main contract between the PO and the supplier, the specific product that the supplier commits to supply is indicated. The buyer, upon receiving the goods, can visually check whether the goods delivered are the ones they purchased.
In each module of goods, services, and works in the CPO LT catalog, all technical specifications are published, from which the PO can choose the products they need and announce an order. Buyers cannot purchase goods through CPO LT according to their specified technical parameters that are not in the electronic catalogs. If the PO does not find product parameters that meet its needs in the CPO LT electronic catalogs, it can announce a public procurement to acquire them. When conducting centralized public procurements according to the new public procurement legal regulation, there will be an opportunity to more flexibly and quickly change the technical specification, taking more into account the changing needs of the PO.
You can choose the technical specification, not a specific product. According to Article 37, paragraph 5 of the Public Procurement Law, when describing the object of procurement, the technical specification cannot specify a particular model or source of supply, a specific process characteristic of the goods supplied or services provided by a particular supplier, or a trademark, patent, type, specific origin, or production that would favor certain entities or products or exclude them.
If the necessary goods, services, or works are not available in the CPO LT catalog (or if they do not meet the PO's needs), you can acquire them independently. In this case, the PO must organize and conduct the procurement itself – not through CPO LT. Yes, the purchasing organization should inform CPO LT if it does not find the required product in the CPO LT catalog or if the products offered do not meet the purchasing organization's needs. After assessing the suppliers' needs, CPO LT will update/clarify its catalogs. If a decision is made not to conduct the purchase using the CPO LT catalog, the purchasing organization must justify such a decision and publish the supporting document in the buyer's profile and keep it together with other procurement documents in accordance with Article 97 of the Lithuanian Public Procurement Law.
